Terms and Conditions

The booking contract

Terms and Conditions

Please read: this page is a draft that is still being reviewed and has not yet been checked by a lawyer. If anything here is unclear, or matters to your booking, please confirm it with our reception on +91 354 225 2242 or [email protected] before you book, and we will confirm it to you in writing.

These Terms and Conditions govern every reservation made with Hotel Apsara, Darjeeling, whether made through this website, by telephone, by email or in person at our reception. By making a reservation you confirm that you have read them, that you accept them, and that you have authority to accept them on behalf of everyone named on the booking.

1. Who you are contracting with

“The hotel”, “we”, “us” and “our” mean Hotel Apsara, a pure vegetarian hotel at Hotel Apsara, Apsara Building, 6 Laden La Road, Chauk Bazaar, Darjeeling – 734101, West Bengal, India. “You”, “the guest” and “your” mean the person making the reservation and every person staying under it. The registered legal name of the business and its registration details will be published on this page once registration is complete.

2. How a booking is made and when it becomes binding

A reservation request — on this website, by telephone or by email — is an offer to book. It becomes a binding contract only when we send you a written booking confirmation carrying a reservation reference, and not before. Until that confirmation reaches you, rooms, rates and dates remain subject to availability and may change.

Please check your confirmation carefully as soon as it arrives. If any detail is wrong — the spelling of a name, the dates, the number of guests, the room type — tell us at once so that we can correct it. We cannot be held responsible for a booking that fails because the details you gave us were incomplete or inaccurate.

3. Rates, taxes and currency

All rates quoted on this website are in Indian Rupees (INR / ₹) and are quoted per room, per night unless the rate description says otherwise. We do not sell in any other currency. If you pay with an internationally issued card, your bank will convert the amount at its own rate and may add its own fees; those conversions and fees are a matter between you and your bank and are outside our control.

Room rates and all other prices shown are exclusive of GST. Where Goods and Services Tax applies to your booking, it is charged in addition to the price shown, at the rate in force for hotel accommodation on the date of your stay, and it is shown as a separate line before you pay. Under current GST law the rate for accommodation depends on the tariff per room per night: at present 5% where that tariff is ₹7,500 or less, and 18% where it is more. If a statutory tax or levy changes between the date of your booking and the date of your stay, the amount payable changes with it.

What each rate does and does not include — for example whether breakfast is part of the price — is stated on the rate at the time of booking. Anything not listed there is chargeable separately.

4. Payment

Payment terms, including any advance or deposit required to hold a reservation, are shown on the rate you select before you confirm. Online payments are processed by our payment gateway partner; we do not receive, see or store your full card number, CVV or UPI PIN. The balance of your account, together with any charges raised during your stay, is payable before you leave the hotel.

We may ask for a refundable deposit against incidental charges at check-in. If we do, reception will tell you the amount and the means of payment accepted at the property before you pay it, and any deposit is returned at check-out, less only charges you have run up during your stay.

5. Arrival, departure and identification

Check-in is from 1:00 PM. Check-out is by 11:00 AM. Early arrival and late departure depend on the rooms available on the day and cannot be guaranteed in advance; where we can accommodate a request, a charge may apply.

Indian law requires every hotel to register its guests. Each adult guest must present a valid original photo identity document at check-in. We accept a passport, an Aadhaar card, a driving licence or another official government-issued photo identity document. Identity documents issued within the local area are accepted. We are required to take and retain a copy or a record of the document presented.

Guests who are foreign nationals must present a passport and a valid Indian visa. We are obliged to report the arrival of foreign nationals to the authorities in the prescribed form, and we will do so.

The guest in whose name the reservation stands must be at least 18 years of age and must be present at check-in. We may decline to check in a party whose lead guest is absent or who cannot produce identification.

6. Occupancy, children and extra beds

Each room may be occupied only by the number of guests recorded on the confirmed booking. Guests who arrive unrecorded cannot be accommodated until the booking has been amended and the additional charge, if any, settled.

One infant aged two years or under may stay free of charge in a parent's room and is not counted against the room's stated capacity. No additional bed is provided for a child who forms part of the booking. Where a room permits it, an extra mattress can be arranged for an additional guest for a charge of ₹1,500 per night (exclusive of GST), payable at the property.

7. House rules

Our Hotel Policy and House Rules form part of this contract and apply to every guest and visitor. Please read them before you travel. In particular, and because guests sometimes assume otherwise: Hotel Apsara is a pure vegetarian establishment. No meat, fish or egg preparations are cooked, served or permitted to be brought onto the premises.

8. Your responsibilities

You agree to treat the hotel, its fittings and its other guests with reasonable care and respect. You are responsible for any loss or damage caused to the property by you, by anyone in your party, or by any visitor you receive, whether deliberate or careless. We may charge you the reasonable cost of repair, replacement or specialist cleaning, and we will show you what that cost is based on. Where damage makes a room unusable we may also charge for the nights it cannot be let.

We may refuse admission, or require a guest to leave without a refund, where conduct is unlawful, abusive, dangerous, or persistently disturbing to other guests or to our staff. This right is exercised sparingly and never on any ground of race, religion, caste, sex, place of birth or disability.

9. What we provide, and what we do not

We would rather tell you plainly than have you arrive disappointed. Hotel Apsara is a traditional town hotel in the Darjeeling hills. There is no swimming pool, no gymnasium, no spa, no jacuzzi and no children's play area on the premises, and rooms are not air-conditioned. Darjeeling's climate does not call for cooling; rooms are heated or supplied with extra bedding as the season requires.

Facilities such as room service, laundry, transfers and the restaurant operate to published hours and, in some cases, for a charge. Availability of any individual facility on a given day cannot be guaranteed and its temporary absence does not entitle you to a refund of the room rate.

Photographs on this website are illustrative. Rooms of the same category differ in outlook, floor and exact layout, and a specific room number, floor or view cannot be guaranteed unless we have confirmed it to you in writing. Where a room is described as having a mountain view, that view depends on the weather; Kanchenjunga is not visible every day, and we cannot make it so.

10. Cancellation, amendment and no-show

Cancellations, amendments, no-shows and refunds are governed by our Cancellation and Refund Policy, which forms part of this contract. Bookings made directly with us are non-refundable: no refund is given if you cancel, do not arrive or leave early. You are entitled to a full refund if we cancel your booking or cannot provide the room you booked, and to any refund the law requires.

11. Bookings made through travel agents and online platforms

If you booked through an online travel agent, a tour operator or any other third party, your contract for the booking, the payment and the cancellation terms is with that party, under their terms, not ours. We will honour the reservation they pass to us, but we cannot amend or refund a booking we did not take. Please deal with the party you paid.

12. Events beyond our control

Darjeeling is a hill station, and the road to it is not always open. We are not liable for any failure or delay in performing our obligations that is caused by circumstances beyond our reasonable control — including landslides, blocked or washed-out roads, severe weather, flood, earthquake, fire, epidemic, strike, local shutdown or civil disturbance, failure of the public power or water supply, or an act or order of a government authority. Where such an event prevents your stay, we will deal with you in good faith and will look first at moving the booking to other dates, subject to availability. Any refund in that situation is governed by our Cancellation and Refund Policy and by the law.

13. Liability, valuables and belongings

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.

Subject to that, we are not liable for indirect or consequential loss, for loss of enjoyment, or for costs you incur elsewhere — onward travel, tours or connecting tickets — arising from a cancelled or curtailed stay. Our total liability in connection with a booking will not exceed the amount you have paid us for it.

Please do not leave money, jewellery, documents or electronics unattended in your room; keep them with you. Vehicles and their contents are left at the owner's risk.

14. Privacy

We handle your personal information in the way described in our Privacy Policy, which forms part of these terms.

15. This website

The text, photographs and design of apsarahotel.com belong to us or are used by us with permission, and may not be reproduced commercially without our written consent. Photographs of Darjeeling landmarks that appear on this site are the work of third parties and are used under the licences credited beside them. We take care to keep rates, descriptions and availability accurate, but this website is not an offer capable of acceptance, and an obvious error in a price or a description does not bind us. Where such an error is discovered we will tell you promptly and give you the choice of confirming at the correct rate or cancelling with a full refund.

16. Changes to these terms

We may revise these terms from time to time. The version in force when your booking was confirmed is the version that applies to that booking, whatever appears here later.

17. Governing law and jurisdiction

These terms, and any dispute arising out of them or out of your stay, are governed by the laws of India. The courts at Darjeeling, West Bengal have exclusive jurisdiction.

18. Complaints

If something is wrong, please tell reception while you are still with us — almost everything can be put right on the spot. If a matter remains unresolved, write to us at [email protected] or to the postal address below, marking your letter for the attention of the Manager, and we will respond.
